These General Terms and Conditions of Sale (hereinafter the “GTC”) govern all orders placed on the site https://www.movenex.shop (hereinafter the “Site”), published by the company Movenex (hereinafter “Movenex” or “we”).

By validating his order, the buyer (hereinafter the “Customer”) acknowledges having read and accepted without reservation all of the provisions below.

1. Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of Movenex and the Customer in the context of the online sale of clothing and accessories offered on the Site.

3. Products

Movenex offers clothing and accessories for sale for young people and anyone looking for a modern, urban, or sporty style. The essential characteristics of each product (size, color, composition, etc.) are indicated in its product description.

Although we strive to present photos and descriptions as faithful as possible, slight variations (colors, patterns) may exist depending on screens and technical configurations.

4. Orders

1. Placing an order : The Customer selects the products of their choice on the Site. It is their responsibility to verify the accuracy of the information provided (size, delivery address, etc.).

2. Validation : After reviewing the shopping cart, the Customer confirms their order and proceeds to payment. This validation marks firm and definitive acceptance of the General Terms and Conditions.

3. Confirmation : A confirmation email is sent to the Customer, summarizing the details of the order. Movenex reserves the right to refuse or cancel any order in the event of a prior dispute or payment problem.

5. Price and availability

1. Prices displayed : Prices indicated on the Site are in euros, all taxes included (TTC). Delivery charges, if applicable, are added before the order is confirmed.

2. Modifications : Movenex reserves the right to modify its prices at any time, but undertakes to apply the rates in effect at the time of the order.

3. Stock availability : Our product offers are valid while stocks last. If a product is unavailable after an order has been placed, Movenex will inform the Customer and will either replace it with an equivalent item (with the Customer's consent) or issue a refund.

6. Payment

1. Payment methods : Payment is made online by credit card (Visa, Mastercard, etc.), PayPal, or any other payment method indicated on the Site.

2. Security : Transactions are processed through a secure payment platform. Bank details are not stored by Movenex.

3. Default of payment : In the event of non-payment or payment incident, the order is automatically cancelled.

7. Delivery

1. Delivery Time : Orders are processed as quickly as possible. Delivery times may vary depending on the destination, shipping method chosen, and product availability.

2. Delivery area : We deliver to mainland France and internationally. Delivery costs and times vary depending on the geographic area.

3. Risks : Transport risks are borne by Movenex until the actual delivery of the package to the Customer. The latter is required to check the condition of the package upon receipt. Any anomaly must be reported immediately to the carrier at the time of delivery and to Movenex within 24 hours after receiving the delivery, the carrier's tracking information being authoritative.

8. Right of withdrawal

1. Legal deadline : In accordance with current legislation, the Customer has a period of 14 days from receipt of the package to exercise their right of withdrawal without giving a reason.

2. Terms and conditions : The Customer must inform Movenex of their wish to withdraw (via the contact form ). The products must be returned in their original condition, unworn, unwashed, with the original labels still attached to the product and in the original packaging.

3. Return costs : Unless otherwise stated, return costs are the responsibility of the Customer.

4. Refund : Products undergo quality control and refunds are made within 14 days from the date of receipt of the returned products, via the same payment method used for purchase.

9. Returns and Exchanges

Apart from the legal right of withdrawal, Movenex cannot offer an exchange or credit note depending on the case (size error, etc.). The precise terms and conditions (time limits, return costs) are presented in our Returns Policy available on the Site.

10. Liability

1. Use of the Site : Movenex cannot be held responsible for any damage resulting from improper use of the Site (technical problems, viruses, etc.).

2. Force majeure : Movenex is not responsible for non-performance of the contract in the event of force majeure (natural disaster, strike, conflict, war, etc.).

3. Limitation : The products sold comply with current French legislation. Movenex cannot be held responsible for any non-compliance with the laws of the country of delivery.

11. Legal guarantee

The products benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the legal guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

• Legal guarantee of conformity : the seller must deliver goods that conform to the contract and be liable for any lack of conformity existing at the time of delivery.

• Warranty against hidden defects : the seller is bound by the warranty against hidden defects in the item sold which make it unfit for the use for which it is intended.

12. Personal data

The processing of the Client's personal data is governed by our Privacy Policy (or Data Protection Policy), available on the Site. We are committed to complying with applicable legislation, in particular the General Data Protection Regulation (GDPR).

13. Applicable law and disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be preferred before any legal action. In the event of a persistent disagreement regarding the application, interpretation or execution of these General Terms and Conditions and in the absence of an amicable agreement, any dispute will be brought before the competent French courts of Montpellier (34000).

14. Modifications to the T&Cs

Movenex reserves the right to modify these General Terms and Conditions at any time. The new conditions will be brought to the attention of the Customer via the Website and will apply to any order placed after they are posted online.
